Complaint: Served On Juliana Peres Magalhaes Complaint: Served On Brendan Robert Banfield Hearing Scheduled Trial - Jury 02/22/2027 |
Question for the lawyers, if any are still checking in.. The suit has a high probability to be successful... but Brendan does not have assets or future earning potential. The juice doesn't seem worth the squeeze, what am I missing. Thanks, |
He has plenty of assets. |
What on earth does “set aside” mean here?? He was convicted. He wants the court to say “j/k we take it back”? Thanks to any attorney for explaining… |
I googled it: “When a case is "set aside," the court cancels or invalidates a previous judgment or conviction, effectively undoing the final order. In civil cases, this often reopens the case to allow a defense, while in criminal cases, it typically sets aside the judgment of guilt and may dismiss the charge.” |
It's stunning how some people can't or won't face consequences. BB is not going to handle prison well. |
|
I understand what “set aside” means but why on earth would Banfield have an argument to do that?? It must only happen in rare instances of procedural errors? But for BB, he has nothing to lose by throwing whatever he can at the wall and hoping something sticks.
He’s going to jail for the rest of his life and that’s better than he deserves. |
Prosecutor here. Virtually every defendant who loses at trial argues for his conviction to be undone. It is a standard post-trial step. |
|
The house is worth $1Million, so yes, he does have assets.

| The custody hearing is May 8th, right? Judge Azcarate is also presiding over the custody hearing. Please let her do what I think she will do. She retires in July. |
| Doesn’t going after his money just disadvantage his daughter? Can they quickly put everything in a trust for her? |
They were only in the house a few years and even with the equity from their Long Island house applied to the Herndon house I really doubt they had anything near $1 million in equity. Also it’s probably been re-mortgaged to pay for his defense. And lastly “murder houses” do not appreciate. |
Sentencing. not custody. it will be life. |
| Don’t forget that he can make money out of his story. Like Juliana. I think the purpose is to withhold any money they make from that too. |
