Depends on the DA, but it certainly could be considered assault. Spit is a bodily fluid and is offensive. But throwing, say, a small stuffed animal at someone wouldn't. Not offensive. |

You should be ashamed PP for automatically assuming the police over the body camera. The police officer was caught in a lie on the witness stand. He testified that the sandwich opened up and got on his uniform and he could smell the mustard and onions. The cameras showed that the wrapper never opened up. If he lied about the small stuff, what else did he lie about. He had no credibility and he definitely was not in fear of danger or life. |
