First and foremost, everyone wanted the classified documents recovered. Something in the neighborhood of 140 documents have been recovered. But no explanation has been forthcoming about dozens of empty folders.

DOJ understands the damage of charging someone only to have a hung jury or awuittal. The standard of course is proof beyond a reasonable doubt. The other side of the coin is DOJ will need to determine which documents might have to be fevlsssified in order to bring a 793 charge to trial. While classification is not technically a requirement for a violation, DOJ will want to emphasize to a jury the serious nature of the mishandling.

My belief is there are signals intercepts which have given the intelligence community reason to believe that information contained in some of the materials has been compromised. And having gone tomat on a subpoena and warrant it will be difficult to shut this all down without charges against someone other than false statements against a lawyer and a former valet. DOJ will be castigated for a witch hunt by bad faith actors either way.

I think at this point the only way he doesn't get charged, is if he dies first.

The potential witness pool is huge, but they have to be willing to testify and be willing to be placed into a witness protection program because the MAGA warriors will kill anyone who dares to threaten the freedom of their revered Cheato. Most people don't want to ruin their lives to put that old man, who probably has Parkinsons and dementia, in jail. He may never go to jail. He's not young, he's obese, he had Covid, and his diet is appalling. His father had Alzheimer's. I'm guessing he's headed that way too.

best thing to come out of his *presidency was the nicknames. I love this one! & hadn't seen it before. well done!

Seem Dearie is not too impressed with how the review is going so far. He has encountered Trump’s lawyers to submit briefing in the basis for their privilege claims because the logs they have submitted do not provide any substantive explanation if the basis for their privilege claims. He also took them to task a bit for claim at least one document was both a personal document and subject to executive privilege (which generally only applies to government documents).

from the NYT story linked above:

Judge Dearie encouraged Mr. Trump’s lawyers to give him a better sense of why they believed the documents could be lawfully shielded from the Justice Department’s inquiry into whether Mr. Trump unlawfully kept classified records at his estate and obstructed the government’s repeated efforts to retrieve them.

“It’s a little perplexing as I go through the log,” Judge Dearie said. “What’s the expression — ‘Where’s the beef?’ I need some beef.”

The judge also said he wanted more information to support the former president’s claims that some of the documents were shielded by attorney-client privilege. To that point, he asked for the names of any lawyers connected to such materials and suggested that Mr. Trump’s team had asserted privilege over other records even though a third party was involved, suggesting they were not confidential.

I just read “Count of Mostly Crisco;” that’s a new one to me.

Heck, don’t you think that’s what the republicans are praying for?

Not just republicans.

I still can't get over his rapid recovery from COVID.

+1 Evil Never Dies

Someone needs to find the portrait of Trump and burn it.

WaPo latest: “Some of the classified documents recovered by the FBI from Donald Trump’s Mar-a-Lago home and private club included highly sensitive intelligence regarding Iran and China, according to people familiar with the matter. If shared with others, the people said, such information could expose intelligence-gathering methods that the United States wants to keep hidden from the world.”

Nuclear stuff fizzled. If at first you don’t succeed, try, try again.
