Anyone separated from spouse but continue to live together? It seems like we are headed there, and financially, we can't have 2 households any time soon. In va, w kids, I beleve you must be separated for a year.

Depends on the county, and the judge. I was in that position until my wife and I decided to reconcile.
You'll need the witness of course, and it'd help if there was a backstory/reasoning why you wanted to separate. If you get along ok when the kids are concerned, then consider an open marriage where you and DH spend 2-3 nights a week doing "your own thing" and the other one has kid duty (although of course in some cases your nights end up being ones where the kids are acting out.) You'll have to completely separate your lives -- to the point where if you're doing laundry for each other and admit it, you might get denied. Of course, no sexy time but I assume you knew that. Someone could live in someone's basement for $400 a month. |
Problem is if one spouse leaves it is abandonment in VA. Affects custody. So no DH I've known has ever been willing to move out. Have to hammer out a separation agreement first. |
Sounds like working it out should be a viable option barring abuse. |
Really, my stbex told me when I came home from work that he was leaving. Had an apt and everything and moved out the next day. He would have moved same day before I got home but the apt was not available yet. He didn't want custody so not an issue. No chance of reconcile, and man are we happier completely out of each others lives. Can't stand even the sight of him. |
I don't see why the fuck the state cares. What if I want a divorce and still want to share a bed with my ex? What is the problem? If two people want out of the contract, who is the government to say they can't? |
(1) to ensure there's no welfare fraud going on and (2) to ensure the kids are cared for. Throw in a helping of old school morality as well. To add to the irony, either party could get married by an Elvis impersonator in Vegas the day after the divorce is final. |
