Because he is disqualified. On the ballot or off, he cannot be president. So might as well put a qualified candidate on the ballot, right?

No Justice said there was no insurrection. They dodged that question entirely. The Court position seems the be that it was rude of Colorado to ask the Supreme Court to interpret the Constitution.

That’s where state law comes in. In some states filing to be on the ballot requires the candidates to swear that they are eligible for the office. And if a registered voter presents evidence that a candidate is not eligible, election officials must investigate and make a determination whether to place them on the ballot.

Because unlike Republicans, most Democrats actually care more about the country than the party. We recognize that Trump is uniquely horrible for the country and letting him get away with insurrection and treason would be historically bad decisions, even if that means a different Republican becomes President.

Here is the text of the Fourteenth Amendment (it doesn't say anything about being charged or convicted):

Section 3.
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

So what you are saying is I can just say Joe Biden is an insurrectionist? Or do will have some other steps.

It goes like this: Texas declares Biden an insurrectionist for providing aid and comfort to migrants coming across the boarder who are terrorists and he's off the Texas ballot. Add NM and AZ. Now it's almost mathmatically impossible for him to win since he'll lose all those votes.
