You should look at the Arizona murder statute before saying something like this. Second degree murder:

“Under circumstances manifesting extreme indifference to human life, the person recklessly engages in conduct that creates a grave risk of death and thereby causes the death of another person, including an unborn child or, as a result of recklessly causing the death of another person, causes the death of an unborn child.“


Leaving a 2-year-old alone in a car in the summer in Arizona when it is 110 degrees outside certainly meets that standard.

20-30 years seems like a crazy high sentence under a plea agreement. It was negligence for sure but ultimately an accident. A number of other parents responsible for hot car deaths were never even charged. I'm a bit perplexed by this.


There is always more to the story that is suppressed for political reasons.

Yeah it's weird. It's (unfortunately) a fairly normal thing for a lot of people to leave babies and toddlers in their car, while they sleep after coming back home. His intent was not to kill. It probably was not on his mind that it was so hot and this could have happened.

Yes, his wife is an anesthesiologist. From what I’ve read, the husband had an addictive personality and perhaps she was enabling him? Not sure of the dynamics there. I’m wondering if the wife told him she planned to divorce him while he was incarcerated and that was the final straw.

Has anyone read about his first child, now a 17 year old? He had custody of her at one time and she recently filed a lawsuit against them for maltreatment and misappropriation of her SSI payments (she has Type 1 DM). She had previously reported him to CPS but none of her concerns could be validated, apparently. Her mom ( who never married Scholtes) died of cancer a while ago. So sad.

I think public outrage might have contributed to the severity of his sentence.

It’s interesting that his MIL initially supported him until she followed social media that was extremely critical of him. Then she turned against him and became estranged from her daughter and grandkids.

He actually was offered a plea deal of 10 years. They declined it. Then discovery happened and it came out he was actually inside for hours watching porn and had a history of doing this with his other kids, one of whom was removed from his custody. That’s when he got the 20-30 years.

DCUM posters are not big on nuance. In fact, most appear to be utilitarians. From that view, we have a dead body as the outcome in both cases. It doesn't matter how you got there.

His case was very different. He left her in the car intentionally on a regular basis. He just got caught this time. He didn’t forget she was there. He knew where she was the whole time.
