Except that DGS hasn't carried out the studies that it committed to the area ANCs. That's stupid, because it will end up delaying, if not scuttling, the pool. Mayor Stupid doesn't exactly appoint rocket scientists to head DC agencies.

I was at one of the public meetings when this came up.

DGS committed to doing the studies that are required by law.

My recollection is that they committed to looking into the study requested by the ANC. But an ANC request is not a requirement nor does it have to be given great weight.

Even DC Government agencies have to get permits and if necessary zoning relief and DCRA will not issue their permits without any required studies having been completed.

The neighbors think they've somehow moved the goalposts and are the referees but neither is true.

I'm surprised that you would cite McMillan, as it's kind of the recent textbook example of DC agencies failing to do the analysis and make the findings that they're supposed to. The courts really took the DC government to task.

Well the McMillan citation was odd but you know as much about the case as the earlier poster it would seem.

The "agency" that was cited by the Court of Appeals was the Zoning Commission which is not an agency but an appointed board. The ruling also pointed out the many problems with contradictory language in the Comprehensive Plan which is a law passed by the DC Council.

None of which really contains any illuminating or relevant points of comparison to the Hearst pool process.

Now there are all sorts of concerning things about how "DC Government" operates that you could cite, including from the McMillan process, that would potentially be of comparative value.

But you have no idea what you are talking about and didn't manage to do that.

The Neighbors of Hearst Park group is sponsoring a community clean up of the Park on Earth Day. It would seem that the immediate community does care about the conservation and stewardship of the park, rather than simply selfish interests as the Crazy Pool Mom asserts.

Yet there is ivy overtaking a significant number of trees on the western edge of the park - ivy that has taken years to grow. So the neighbors haven't been paying much attention to what is going on in the park.

In any case it will be nice to see some neighbors in the park this weekend - most weekends there are more off leash dogs than people in the park!

That's nice that after decades, they decided to do this. But it doesn't change that they don't own the park and have no greater stake in its stewardship than any other resident of the District of Columbia.

Awesome though it would be nice for them to hustle so the pool is open by next summer - the piece doesn't have the full construction timeline but as I understand it the pool will be built next summer and not open until the summer of 2020 when I will indeed have a teenager.

If DPR/DGS haven't done the studies that are required, then be prepared for lawsuits to delay the pool, if not kill it outright. DC is still so Third World in its governance -- you'd think that agencies would finally get their act together so that things could move forward.

They know they have to do the studies - they are required to get the permits from DCRA.

The question is, what happens when the studies don't provide the results the NIMBYs desire?

Are you going to waste the rest of our tax dollars to quell your desire to keep a pool out of "your" neighborhood?

What are you going to file a lawsuit over?

Improper issuance of permits? There is no zoning relief or public space issue here so you have no board rulings to appeal.

As long as they've completed the environmental reviews (which are required and something DGS has properly done on other projects in Ward 3) what exactly will you be suing over?

Being unhappy is not a reasonable basis for a lawsuit - you can come to DCUM to vent about your displeasure with this project.
