but I received it (late) and deposited and wrote checks and paid bills and now it has come back to my bank.. they called me and notifiied me of the problem today so now I have a 1500 dollar bounced check from his bank and I have several checks of mine which are going to be bounced because of this.. this is going to cost me hundreds of dollars in fees. Im not really sure what to do I called and left a message for the lawyer... im in the middle of a custody dispute and I feel like hes trying to push me into a corner and get me to a level of poverty again so he can try and "take our son"), he has admited to doing this previously. |
Why isn't he paying the state directly? He shouldn't be sending you money. |

She needs to go through the state in the future to avoid this BS. Sounds like my own dad back in the 80s. Make the whole process much easier and set it up through the state. Do they even have a record of how much he is paying you in support and when he pays it? |

No, my parents didn't share custody. That's a relatively new thing. It won't cost her anything to get an application from her local child support enforcement office, fill it out and mail it in. Her ex should be paying child support through the state so this kind of stuff doesn't happen in the future. I didn't pay a cent to do it this way. My mother used to have to beg my father to pay and when he did, his checks frequently bounced leaving her in a similar spot. It doesn't need to be like that anymore. |
Go to your bank branch. Find the woman manager. Talk with her about trying to waive those fees. Hopefully, these are your only fees in awhile. Save proof of whatever you lose for the next court trip. And Yes start process to make him pay the state. I think a state has better mechanisms for putting bounced checks writers in jail. |

Bouncing a check can be a crime. There are specific steps you must take before you seek a warrant for an arrest, but you can assuredly have him arrested for passing a bad check. If it is over a certain amount of money in VA ($200), the charge would be a felony. |

13:59 Joint custody is 30 years old as of 1979, and it existed for decades among a certain set of divorced parents. You don't know enough about OP's situation to be dispensing this advice. OP needs to ask her lawyer what makes sense.

I am not discussing custody at all PP. Custody and child support are two separate issues. If he owes child support every month, it is risky for him just to be sending her a check and not go through the state. If she went through the state, it creates a paper trail and a case if he continues to pay late and bounce checks. This situation would've never happened if he was paying through the state. Also, if he gets too far behind in support payments, the state can take action against him depending on how much he owes (like taking his tax refund, etc). Custody has nothing to do with the fact that there is a more reliable way of the OP receiving child support. |

Custody and child support are not two issues, if custody changes, the amount owed changes. Anyway, once again, OP's lawyer is the one to advise OP on this! I do not know anyone with joint custody who gets paid through the state. Are you in MD or VA? |
