No, they can’t. Menendez still hasn’t stepped down.

You didn't address the post above. Resignation is one thing. Expulsion is another. Menendez does not need to resign in order to be expelled.

Because he is innocent, as a matter of constitutional law.

He is being tried in court, and the jury is the “finder of fact,” here. The finder of fact has NOT found him guilty. Ergo:
