How to negotiate a 504 Plan?

I would request a meeting to determine eligibility for either a 504 or an IEP. You can't really just say "I want an IEP" and have it happen, there are eligibility requirements.

A 504 is just accommodations/modifications. An IEP involves special education services and accommodations/modifications.

I started another thread the other day (7yo DD has anxiety). I'm wondering if based on the descriptions here whether she would even need an IEP or just a 504. From the sound of it, you WANT the IEP because it's enforceable? Moreso than the 504, at least. I am having trouble distinguishing between the two as I'm totally new at this.

504 vs IEP essentially depends on whether your child needs special instruction or whether preferential seating / more time on tests is enough.

If you think your child needs 1:1 or small group instruction by a special education teacher in one or more subjects - you will need an IEP. If they need so called related services (speech therapy, occupational therapy) you usually need an IEP (not always).

The Psychologist should have recommended EITHER "direct specialized instruction" (IEP) or just recommended accommodations (504). If the term direct specialized instruction was not used, you are heading down the 504 path. Psychologists sometimes do not know that unless an Educational Consultant was able to review the report before it is sent to the school.

They are two separate request letters. One is for an IEP Screening Meeting and one is for an "EMT" Meeting. There is a change you can turn a screening meeting into a 504 meeting but not vice-versa. You really should decide the path before making the request. (Educational Consultant speaking.)

Any accommodation requires an IEP. But you have to show educational impact. A 504 prevents discrimination, and usually those accommodations would follow your kid life long. Request an IEP, OP.

This doesn't make much sense since 504 plans include accommodations so not all accommodations require an IEP

This is incorrect. Accommodations appear on 504 plans and IEPs, IEPs are not needed to get accommodations. The difference is that an IEP requires specialized services, while a 504 plan does not.
