Actually they can. The pardon is for sentencing/conviction. Nothing says they can’t still prosecute and later fight the pardon in the courts.

Manafort had already been released from prison after completing his sentence. Same with Kushner.

Stone had his jail time commuted.

Flynn had pleaded guilty and was cooperating. Biden is suggesting that he can pardon someone who hasn’t even been charged, something the courts have never addressed or upheld. Get it now?
