Child support and custody

I stupidly went back to work full time (after leaving my job during the pandemic) while separated. Now XH wants more custody time than me, since his schedule is flexible.

Would it make sense to take a job with more flexibility and fewer hours, but significantly less pay? Think 40+ hours to 30 hours per week, with a $30k salary drop.

I guess I would also be concerned that the 30 hours was actually going to be 40 in reality. But at least it is remote...

I need to talk to my lawyer to see if I would get any child support if this position changed.

As you said, you need to talk to your lawyer. Don’t get legal advice from randos on the internet.

Look up the concept of imputed income. Changing jobs and taking a salary reduction may never t get you child support.

+1. It's one thing if you were say biglaw and working 70 hours a week and go to a gov or in house job still making good money but 40 hours per week. It's not going to be very sympathetic if you say you're going from 40 hours per week to 30 since most people work 40 hours per week.

Agree with discussing with your lawyer though.

Discuss it with the lawyer but it’s unlikely your XH will get more than 50% unless it’s what your kids want and they’re an age where it matters.
