We don't know that he actually saved lives. But nothing can be proven beyond a reasonable doubt here. He should be acquitted. |

I think the issue is that he might have saved their lives but also could have just knocked out Neely without killing him, and as a Marine would have known where that line was. I think he was overcharged but I’m not surprised it’s deadlocked. |

I've agonized over this story because like many of you, I've been on the subway with my kids when an unstable person is present and it's terrifying.
As I read more about the case, I learned what a sad life Neely had. When he was young, his mother was killed by her partner and he fell through every single crack. I don't envy the burden that Penny must now carry but I know if I'd been on that car, I'd be incredibly grateful to him. |
I think it was manslaughter. He didn’t mean to kill him but he could have used much less force to subdue him. |

I think that’s Neely’s fault though. I realize this is a criminal case and not a tort case where comparative fault is relevant. But it’s basically inevitable that if someone violent and mentally decompensating threatens people in public, someone is going to react to stop them, and it’s impossible to tell in advance the “correct” level of force in many cases. |
