Unable to work due to health issues

Anonymous
Unable to work much longer due to health issues. Optimistic I can heal over next 3-6 months (long COVID type issues). I’m based in CA.

I know I have employer sponsored disability insurance. But my bosses told me I would have to quit if I took this (which I don’t think is legal, but unclear).

Anyone familiar with this dynamic and know what my options are as it comes to disability leave?

No idea about about CA law. But if your employer is subject to FMLA, you can get 14 weeks of job protection if you qualify. CA tends to have good employee protections so there might be more available. But generally speaking, outside of some job protection laws or a collective bargaining agreement, employers can fire you for not coming to work even if you’re sick. It’s a huge problem for example when people get cancer and need months off to treat their illness.

It might be worth talking to a lawyer about this. If your bosses already told you you would have to quit, this job is done one way or another. But a lawyer will make sure you get every penny of your insurance and that they don't screw you over when they fire you. And make them do it so you can get unemployment while you search for your next job.

Good luck OP, and hope you feel better soon.
