Also, the fed conviction rate against well-funded defendants who are not in pre-trial confinement is not nearly so good. The high conviction rate (overwhelmingly pleas) mostly reflects the fact that most defendants are poor, sitting in jail awaiting trial, and can't fund an adequate defense.

He doesn't have to explain any of that. The burden of proof is on the gov. And they are going to have a very hard to proving he got any of this in exchange for an official act.


Parsing the indictment, it sounds like Menendez got caught on intercepts of foreign comms. So he was communicating with foreigners (Egyptians?) we were already surveilling and started talking about pay-for-play.

It astounds me how deeply Egypt's tentacles go into DC right now. They got both parties sewn up.

And in the meantime, SCOTUS and the second circuit have been throwing out public corruption cases left and right. Earlier this year, SCOTUS threw out the conviction of a former Cuomo aide who was taking money from developers who was using his power to get them out of having to negotiate with unions. And the the second circuit threw out the conviction of state senator who was taking money in return for helping to direct grants. And the second circuit also threw out a few counts of Sheldon Silver's conviction for accepting bribes. It's become very very hard to prove bribery of public officials, even when it is very clear they took money from people and then did things that helped those same people out.

My husband is from there, my daughter is currently at college there, and I spend about a third of my time there and own three different properties there. There will be no New Jersey residents in an SDNY jury.

Nearly half a million dollars in cash was found stuffed inside envelopes and stashed inside the pockets of clothing hanging in the closets of the Menendez's home in Englewood Cliffs, including a big roll of bills in a jacket from the Congressional Hispanic Caucus with Menendez's name on it.

Fingerprints belonging to the driver of co-defendant Fred Daibes were found on at least one of the envelopes, as well as his DNA and his return address, prosecutors said. "Thank you," Nadine Menendez texted Daibes around Jan. 24, 2022, according to the indictment. “Christmas in January.”

Patrice Schiano, a former FBI forensic accountant who is currently a lecturer at the John Jay College of Criminal Justice, said that’s “pretty damning.”

“It doesn’t surprise me that there might be cash hidden in the house because if they took it to the bank that’s going to be reported,” Schiano said. “But that’s going to be hard to defend because any jury is going to be like, ‘That’s a lot of cash in house’.”
