Help bringing au pair back RSS feed

Our au pair of 2 years went back to Mexico. She applied for a tourist visa to come visit us, but was denied. She then continued to proceed with looking at colleges, as she wanted to attend school here but if she changed her status from J-1 to student she wouldn't be able to go home to see her family. So, back in Mexico she applies for community college in our town and was admitted, but then they denied fer visa. I am just baffled at this: she has land in mexico, her entire family is there, bank accounts, etc. The college program is 2 years. The issued the 214(b) stating that she didn't show strong enough ties to Mexico to prove she would come back when the program is done.

Does anyone have experience dealing with this that they can offer advice? Aside from paying an immigration attorney...she is an amazing person and I would do anything for her, she's a member of our family. We are all heartbroken over this.

I was a consular officer in a country with a similar visa refusal rate and am not at all surprised. She is a very likely overstay risk - young, single, striving for a better life, connections in the US... No lawyer will help you overcome this. She should build a life in Mexico and try again in a few years.

Same poster as 11:20 - it also hurts her case that she had applied for the tourist visa - seems like she is shopping around for a way to get back

You and your spouse divorce, then one of you marries the Au Pair and brings her over as your legal wife.

No chance now - two rejections = she won't get a non-immigrant visa anytime soon. Especially not to come back to your town/live with you while you "sponsor" her to go to school while she just "occasionally" have her do a "little babysitting" - but NICE TRY!

Her family is not rich enough. She’s a potential overstay.
