I was sexually involved with my boss for the past few years. He retired over the summer. My company has announced layoffs next week. I am scared because my direct reports were laid off last year, and my department was going to be eliminated then, but my boss saved me/my job. I'm scared that with him gone, they are going to finish the job.
My question is this: I know they can't fire me if I am having sex with my boss, because of sexual harassment laws. How long does the statute of limitations last on that? Can they fire me now that he's gone or is that retaliation? |

You can try. But from what you've said it's not a very strong one. They're eliminating the position and they've already eliminated the rest of the group. You're boss isn't there any more. You'd be hard pressed to argue this is retaliation. Additionally, it would be crazy expensive. |

Yes, it was consensual, but he was in a position of power over me, which makes it sexual harassment.
I think the actions are by management (his former bosses), because they don't like the fact that we were sleeping together (don't know if they know or not). |

Do you have evidence that they knew or should have known? Do you have evidence that they want to fire you because you were sleeping together (as opposed to eliminating your job)? |
There was mutual attraction. He was an excellent mentor, and I do not regret our relationship. I've learned a lot about my industry, and made some great connections because of our relationship. |
How would management fire you for sleeping with the old boss if they don't even know about it? From what you said, only the fact that you were sleeping with him saved your job last time, given the broader layoffs at the company. Focus your efforts on trying to do a good job to stave off a layoff and/or start looking for a new job. Your conceptions of EE law are way off base and it sounds like you would have no case. |
He is married, but his wife lived in another state (they live together now that he is retired). I am not married, but I am hoping my boyfriend proposes soon.

So your question is whether you can make up a retaliation case, when there was no actual retaliation? And when your boss, who you were having sex with, actually did you a favor?
