It can’t be appealed after a jury has been seated. Leaving the decision open has made it unappealable at this point. This is why I’d like to know about the steps needed to remove a judge from a case. |
We are witnessing in real time is the rule of law being applied to subvert the law. Our system was not built for the Trumps and enablers like Cannon. Muller, Jack Smith, SCOTUS won’t save this country. We, everyday citizens will. Donate & volunteer today for any Dem race in swing state. Voting isn’t enough. And don’t come at me with sitting out/3 party crap. Be a grownup and accept the reality we’re in, not the fantasy you want. |
The only surprise with the clerk quitting is that there’s a point when even a conservative has to call it quits for their sense of self. What’s the invisible line for those people? It’s not like it was a surprise that Cannon was incompetent and corrupt. |
Doesn't this judge have any friends who can persuade her that she needs to be conduct herself professionally?
Because applying the wrong law is a lose-lose for her. Trump has many other trials in which he has, and can, be found guilty. It's not like this one is the only one. Trump, whether or not he's President again, will die soon, and everyone else has a very poor opinion of this Judge, even the conservatives in her own party. Someone should tell her she's creating serious career and reputational harm for herself. |
Honestly, it’s good that we’re out two MAGA clerks - love to see it! |
The Code of Conduct for United States Judges is the applicable standard. Otherwise, if she gets something wrong, the litigants must appeal and allow the 11th Circuit to overrule. Absent either of these, there is nothing anyone can do. As for her career and reputation, she seems to keep her own counsel, as many judges do. |
This is Orwellian. There must be someway to hold a judge accountable beyond reminding her that her reputation will be tarnished. |
There are ways but it’s a very high bar and most analysts don’t think she has met it yet. |
Jack Smith indicating she’s close though. |
“U.S. District Court Judge Aileen Cannon on Thursday rejected Donald Trump’s bid to have his charges of mishandling classified documents dismissed on the grounds that a federal records law protected him from prosecution. The judge also defended her handling of the issue, which had frustrated prosecutors.
Trump’s defense team argued the Presidential Records Act took priority over the Espionage Act when it came to highly classified documents that he took to his private residence in Florida after his presidency. On Thursday, Cannon shot down that argument, saying the PRA “does not provide a pre-trial basis to dismiss” either the mishandling charges or the related obstruction charges against Trump.” https://www.washingtonpost.com/national-security/2024/04/04/cannon-trump-jack-smith-presidential-records-act/ |

As early as 2018, the Office of the Staff Secretary, which manages the documents flowing to the Oval Office, began asking personnel in the White House about documents that had gone missing, including some classified ones, one of Trump's personal valets told investigators, sources said.
And at one point, sources said the valet recalled, he even warned the staff secretary's office that classified documents were being taken out of secure locations in white boxes and ending up in all sorts of potentially concerning places. According to the sources, several witnesses told Smith's team that they routinely saw classified documents or classified folders in Trump's White House residence, and that Trump would sometimes store as many as 30 boxes in his bedroom, which one valet said Trump treated "like a junk drawer." https://abcnews.go.com/US/appalled-witnesses-told-special-counsel-trumps-handling-classified/story?id=109362691 |
We can only wonder how many of these documents he sold to foreign governments. He has blood on his tiny little grease covered hands. |
